Health care payers around the world favor the use of relatively inexpensive generic drugs as one of the most effective ways to curb pharmaceutical expenditures, yet some countries are only beginning to exploit the cost-cutting potential of generic medicines.

In this Decision Resources report, recent trends in generics substitution in the United States, France, and Germany are analyzed. The report discusses the growing pressure on pharmacy benefit management companies (PBMs) in the United States to dispense generics rather than branded medicines, it examines how the rapid increase in generics substitution in France has influenced the development of the French reference pricing system, and explores the growth of the German generics market and the growing criticism of generics substitution regulations in that country. It concludes with a brief assessment of the outlook for generics substitution in these three countries and the implications for the research-based pharmaceutical industry.

Increasingly, U. S. employers prefer their pharmacy benefit management companies (PBMs) to promote the use of generics rather than to pursue manufacturer discounts and rebates on branded medicines. A 2004 survey found that 77% of employers believed that it was very important for PBMs to focus on substituting generics for branded medicines. In previous surveys, maximizing manufacturer rebates generally ranked as one of employers' highest priorities, but only 44% considered this strategy very important in 2004.

Data from a leading PBM indicate that every 1% increase in generic dispensing reduces clients' pharmaceutical expenditures by 0.6%. Members' out-of-pocket costs for generics may be 30-60% lower than for equivalent branded medicines. An internal document from one PBM revealed that, in 2001, the company was prepared to lose money on certain branded medicines to take advantage of the potential profit from generics dispensing. Through its mail-order pharmacy business, this PBM made an average loss of $1.24 on each branded drug prescription it dispensed, compared with an average profit of $21.85 on each generics prescription.

A recent study estimated that U. S. consumers could have saved $20 billion in 2004 by more extensive use of generics in six widely prescribed drug classes (antidepressants, antihyperlipidemics, antihypertensives, calcium-channel blockers, gastrointestinals, and nonsteroidal anti-inflammatory drugs [NSAIDs]). The authors advocate therapeutic interchange—replacing prescriptions for certain patent-protected branded drugs with compounds that are available generically.

In France, pharmacists have largely driven the recent rapid growth of the French generics market, and their enthusiasm for generics substitution has shaped the country's incipient reference pricing system. In August 2005, French pharmacists substituted generic products for an average of 61.3% of prescriptions for drugs that were outside the reference pricing system and available as generics. However, the government now appears poised to shift the onus to manufacturers by introducing automatic reference pricing two years after patent expiration. Experience suggests that expanding the reference pricing system could impede the continued expansion of the French generics market, but this risk will not worry the government unduly—as long as overall pharmaceutical spending slows down. From the political perspective, generics are essentially a means to the end of pharmaceutical cost-containment.

Critics of Germany's generics substitution rules have suggested that many manufacturers and pharmacists have exploited the system for their own gain. Some manufacturers reportedly circumvented the aut idem rule by making minor changes to their products to preclude substitution. A leading health insurance fund association reports that the average price differential between new generics and their respective originator brands declined from an average of 40-50% before the introduction of generics substitution to an average of 20-25% after the implementation of the aut idem rule. Furthermore, this association asserts that the prices of generic products now typically vary by just a few cents, a situation that the association denounces as "cartel-like." Pharmacists receive (and retain) very substantial rebates from generics manufacturers, a practice that the government is reportedly planning to outlaw.

Foul play is suspected in the disappearance of retired NBA player Bison Dele, formally known as Brian Williams (age 33), and his girlfriend Serena Karlan (age 30), along with a crew of three, who have been missing since July 8. They were scheduled to sail on their boat, the Hukuna Matata, from Tahiti bound for Hawaii. Concerns heightened when a man claiming to be Bison Dele, and in possession of Bison's passport, check book, and credit cards, attempted to purchase $152,000 in gold coins from a Phoenix Arizona coin dealer on September 5th. The man turned out to be Bison's brother, Miles Deborg, who had been sailing with Bison during the prior months. The FBI is now involved. Prior to July 8, Serena Karlan had been contacting her mother at least once a week and Brian had been contacting his bank and Kevin "KP" Porter, his executive assistant in Michigan, once a month. On August 27, the Coast Guard and Tahiti Search and Rescue opened search cases for their boat from Hawaii through New Zealand. Bison Dele, formerly known as Brian Williams, played NBA basketball with the Denver Nuggets, LA Clippers, 1997 NBA champion Chicago Bulls, and most recently with the Detroit Pistons from 1997-1999.

The parents of both Serena Karlan and Bison Dele are seeking any help they can get to locate Bison and Serena and the rest of the crew of the Hukuna Matata.

NEW INFORMATION

On Friday, August 31, Kevin "KP" Porter discovered that a check for $152,000 had been drawn on Bison's account to purchase Golden Eagle coins from a Phoenix Arizona coin dealer, Certified Mint, for delivery to a Mail Boxes Etc in Miami. This set off an alarm because for 10 years Mr. Williams has only paid bills with certified checks or his credit card and did not write any personal checks during that period. KP contacted Bison's bank and was informed that the signature did not match the one on file. The check used had the Miami Mail Boxes Etc. address and was part of a check order placed only two weeks prior. Bison has never had this Miami Mail Boxes Etc. address.

KP called Certified Mint which had cleared the check but had not yet shipped any coins. The owner, Bill Haynes said that they had received two phone numbers from the person who ordered the coins using "Brian Williams" (Bison's) name, one was from Miami and the other from Key West. KP vouches that the voice on the answering message in Key West has Bison's usual outgoing message, but is in the voice of his Bison's brother, Kevin "Miles" Williams.

On Tuesday, September 3, the man calling himself Brian Williams, called Certified Mint saying that, instead of receiving the coins in Miami, he had changed his mind and was instead coming to pick them up in Phoenix on Thursday. At this point the Phoneix police became interested in the case. On Wednesday September 4, Patricia Phillips (Bison's mother) and KP flew to Phoenix and the bank notified the Phoenix police department of the possible forgery.

On Thursday afternoon, September 5, Miles entered Certified Mint and indentified himself as Bison. He showed Bison's passport as proof. At that point, the Phoenix police arrested him. He was in possession of Bison's passport and two credit cards. He was taken to the Squaw Peak station and questioned. All attempts to gain further information failed and did not give them any other information useful in our search for Serena, Bison, or the other crewmembers. Unfortunately because the police did not have all of the necessary requirmenents of forgery and other crimes, he was released on Thursday evening. KP met Miles as he exited the police station and further questioned himfor 5 hours but was not able to get any more information before Miles boarded an airplane to Palo Alto. Miles not been seen since Friday 5:30 am Sept. 6, 2002.

Friday noon we were informed that the FBI has become involved in their Phoenix, Troy, MI and Honolulu offices.

The Phoenix police are creating two reports regarding their discussions with Miles. These reports numbers are:
